Terms of Use
Updated on September 2, 2026
Welcome to Capsule. These Terms of Use govern access to and use of our service. By creating an account, joining an event or uploading photos, you agree to them. If you do not agree, please do not use the service.
Capsule is operated by Lucas Fonseca Soluções em Tecnologia Ltda., a company incorporated in Brazil under company number (CNPJ) 40.142.373/0001-11.
1. What the service is
Capsule is a digital disposable camera for events. A host creates an event and shares a QR code; guests take photos from their phone's browser, with no app to install and no account to create. The photos stay sealed and are revealed at the time the host has chosen.
2. Accounts and access
- To create events as a host you need an account and you must be 18 or over. You are responsible for keeping your credentials secure and for everything done through your account.
- Guests join anonymously, with no sign-up. They are identified only by a device identifier and by a display name they choose themselves.
- The information you give us must be true and kept up to date.
3. Content, photos and image rights
Photos belong to whoever took them. By uploading a photo to an event, you grant that event's host and its other guests a licence to view and download that photo inside the service. Photos are private to the event: Capsule does not make them public and does not use them for anything else.
You confirm that you hold the rights and permissions you need over what you upload, including the agreement of the people who appear in it. Where a photo includes a child, it is for you to have a parent or guardian's agreement. Hosts are responsible for telling their guests that photos are being taken at the event.
If you appear in a photo and want it removed, write to info@capsule.film. You do not need an account to ask, and you do not have to explain why.
4. Permitted and prohibited use
You agree not to use the service to:
- Upload content that is unlawful, abusive, violent or discriminatory, or that infringes anyone's rights;
- Upload intimate or nude images without consent, or any content that exploits or endangers children;
- Infringe anyone's image, copyright or privacy rights;
- Work around limits, gain unauthorised access, overload the service or compromise its security;
- Do anything unlawful, or anything these terms do not permit.
You can report content that breaks these terms or the law — including misuse of your own image — at info@capsule.film. We review reports, and we may remove content and suspend accounts that break these terms.
5. Plans, prices and payment
- You pay once, per event. There is no subscription, no monthly fee and no recurring charge.
- There is a free plan, limited to 6 guests and 12 photos each. The other plans are paid, and differ by how many guests may join and how many photos each of them may upload.
- Current prices are shown on this site and, finally, on the event creation screen before you confirm anything. The amount shown there is the total you pay: any tax that applies to your purchase is included in that figure, and nothing is added afterwards.
- Payment is handled by a third-party payment provider. We never receive or store your card details.
- An event is only opened to guests once payment is confirmed.
- We may change prices at any time. A change never affects an event that has already been paid for.
6. Your right to withdraw, and refunds
You have 14 days from the day you buy to withdraw, without giving any reason. To do it, write to info@capsule.film — a clear statement that you are withdrawing is enough, and there is no form to fill in.
We do not ask you to sign that right away. There is no box to tick that shortens the 14 days, because a service of this kind cannot be exempted from the withdrawal right.
- If the event has not been used — that is, if no photos have been uploaded — you get the full amount back.
- We may keep a proportionate amount for what was actually supplied only where you expressly asked us to open the event before the 14 days were up and acknowledged at that moment that this is what it means. Unless we asked you for that and you gave it, we deduct nothing, and you get the full amount back even if the event was used.
- If the event cannot go ahead because of a failure on our side, you get the full amount back, whatever the deadline above.
- Refunds go back to the payment method you bought with, within 14 days of you telling us you are withdrawing.
We offer the same 14 days to every customer as a matter of contract, wherever you live. Where the law where you live gives you longer, or gives you a better right, that law applies and this section does not cut it down.
7. Capacity and event limits
- Each plan sets how many guests may join an event and how many photos each of them may upload.
- A guest is anyone who joins the event, whether to take photos or only to see the album after the reveal. The host takes up a place too, since the host also takes photos.
- Once the capacity you bought is reached, further guests are turned away. You can increase an event's capacity after it has been created, at any time before the reveal, from your dashboard: you pay only the difference between your current plan and the new one. An upgrade only increases capacity. It cannot be reduced, the difference is not refundable, and upgrading is no longer available once the capsule has opened.
- A host can remove a guest and change the event's access code at any time. Changing the code cuts off anyone holding the old link.
8. Service availability
We work to keep the service up and working well, but it is provided as it is, without a guarantee of uninterrupted availability. We may change, suspend or discontinue features at any time. Hosts and guests should download the photos they want to keep once the event has been revealed.
9. How long photos stay available
An event's photos stay available for 6 months after the reveal on the free plan, and for 12 months on the paid plans. After that we may delete them permanently, with no way to get them back.
So download the full album soon after the reveal if you want to keep it. You can also ask us to delete your photos or your event earlier, at any time, at info@capsule.film.
10. Limitation of liability
To the fullest extent the law allows, Capsule is not liable for indirect loss, for lost data or photos, or for content uploaded by users. We are not responsible for what hosts and guests do with photos, nor for obtaining the permissions that go with them — that is for the person who takes, uploads and shares the content.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or under the rights the law gives you as a consumer.
11. Data protection
How we handle personal data is set out in our Privacy Policy, which describes what we collect, what we do with it, and the rights you have under the GDPR, the LGPD and US state privacy laws.
12. Changes to these terms
We may update these Terms of Use from time to time. The effective date at the top shows when they last changed, and we will announce anything significant through the service. Continuing to use the service after an update means you accept the new terms.
13. Governing law and disputes
These terms are governed by the laws of the Federative Republic of Brazil.
That choice cannot take away protection you already have. If you are a consumer, you keep the mandatory protections of the law of the country you live in, and you can bring a claim in the courts there. We say so here so that nothing in this document reads as asking you to give that up.
If something goes wrong, write to info@capsule.film first — most things are quicker to fix directly. We are not currently signed up to any alternative dispute resolution scheme. Depending on where you live you may still be able to take a complaint to a consumer body or a regulator, and being told that plainly is more use than a link to a service that would turn the case away.
